Further UP/UPC delays

It is deeply disappointing that the Government have today confirmed that the Referendum to vote on Ireland’s participation in the Unitary Patent system is not going to take place as was previously indicated on 7th June. This referendum is necessary to allow Ireland’s participation in the Unitary Patent System.   

The Unitary Patent system which is already in existence in Europe since 1 June 2023, provides a one-stop-shop for the registration and enforcement of patents in Europe. This means lower costs, less paperwork, and reduced administrative burden for innovators, in particular for SMEs. The Unitary Patent System replaces the need to navigate a complex patchwork of national patent laws and procedures and associated expense. This Unitary Patent System provides an opportunity for Irish inventors to save time and money when protecting their innovations. It is particularly beneficial for micro entities, small medium enterprises (SME’s), individual inventors and/or researchers. Ireland’s involvement in the European system is also important for Foreign Direct Investment.  

Ireland’s participation in the Unitary Patent System is hugely important to APTMA’s innovative technology clients, in particular those clients that are contributing to Ireland’s innovative economy through their research and development across numerous technology areas.   

APTMA calls on Government to support Irish inventors by urgently providing a new date for a stand-alone referendum which will ultimately provide clarity for innovators and also ensure that the electorate are fully prepared to vote on this important matter for Irish businesses.
